These T&C/EULA govern the use of the mobile application “Groopia” (hereinafter the “App”) and the related services. Provider: Groopia UG (limited liability), Straße der Jugend 18, 14974 Ludwigsfelde, Germany, Email: service@groopia.com. Any deviating terms and conditions shall not apply unless we expressly agree to them in writing.
User: any natural person who installs or uses the App. In-app purchases: digital services purchased within the App, depending on the platform, via the Apple App Store or Google Play. Subscription (“Subscription”): an automatically renewing in-app purchase with recurring term and payment.
The App enables, among other things, searching for, creating, and managing groups, as well as access to additional premium features (details in the App description). The scope of functions, system requirements, and supported devices may change through updates.
Registration may be required for certain features. You are obliged to provide truthful information, keep access credentials confidential, and report any misuse immediately. The App is available to minors only in accordance with the legal provisions of their country/state of residence.
We grant you a personal, non-exclusive, non-transferable license to use the App on devices that you own or control and that are associated with the respective store account. On iOS, the license applies in particular to Apple-branded devices in accordance with Apple’s rules; Family Sharing is permitted in accordance with Apple’s rules. On Android, use of the App is subject to the applicable Google Play terms. Mandatory statutory rights remain unaffected.
You are prohibited from renting, leasing, selling, redistributing, sublicensing, or attempting to decompile, reverse engineer, or create derivative works of the App, except to the extent such restriction is prohibited by mandatory law. You may only use the App lawfully and must not infringe any third-party rights.
You are responsible for the content you provide. In particular, unlawful, insulting, discriminatory, harmful to minors, or copyright-infringing content, as well as spam, is prohibited. We may block or remove content if there are legitimate reasons to do so.
Zero-tolerance policy. Groopia expressly prohibits any form of child sexual abuse, child sexual exploitation, and sexualized content involving children or minors. In particular, any content, messages, requests, profiles, group descriptions, or other conduct that concerns, promotes, glorifies, facilitates, or depicts child sexual abuse or child sexual exploitation is strictly prohibited. This includes, in particular, child sexual abuse material and exploitative content as understood under internationally recognized child-safety standards.
Reporting suspicious content. Users may report suspicious content, messages, profiles, or behavior at any time via available in-app reporting and blocking functions or by email to service@groopia.com.
Review & measures. Groopia reviews such reports to an appropriate extent and reserves the right to remove content immediately, temporarily suspend or permanently disable accounts, and restrict certain functions or access if a violation of these standards or applicable law is identified.
Cooperation with authorities. Where legally required or permitted, Groopia may report confirmed or sufficiently substantiated cases to competent authorities, law enforcement agencies, reporting bodies, or child-protection organizations.
Minimum age & protective measures. Use of the App is permitted only in accordance with the applicable legal age requirements. Accounts for which there are indications of a breach of age requirements or of these child-safety standards may be restricted, reviewed, or removed.
Platform role. Groopia provides a technical platform to connect users and facilitate the organization of meetups and group activities. Groopia is neither the organizer nor a party to any arrangements between users. Meetups and activities take place at the users’ own discretion and responsibility.
Personal responsibility & risks. Participation in meetups/activities (especially offline meetups) is at your own risk. Users are responsible for choosing a safe location, time, and process for any meetup and for complying with applicable laws, house rules, and safety rules.
No identity or background checks. As a rule, Groopia does not conduct comprehensive checks of the identity, background, or intentions of other users. Any verification features (e.g., email/phone verification) are solely intended to help secure accounts and are not a guarantee of identity, conduct, or reliability.
Safety recommendations. We recommend in particular: meet for the first time in public places, inform a trusted person, share location/time, trust your instincts, end a meetup if you feel uncomfortable, and use block/report features in cases of inappropriate behavior.
Liability for interactions. To the extent permitted by law, Groopia assumes no responsibility for the acts, omissions, statements, and content of other users or for damages arising from meetups or interactions between users (online or offline). Otherwise, the provisions in Section 12 apply.
Indemnification. To the extent permitted by law, users shall indemnify Groopia against third-party claims arising from a user’s breach of these T&C/EULA, content provided by the user, or the user’s conduct toward other users, unless Groopia is responsible for the claim.
Processed via app stores. In-app purchases and subscriptions are processed, depending on the platform, via the Apple App Store or Google Play. The respective terms of Apple or Google also apply. The binding price is displayed in the respective store before purchase and may vary by region.
Term & renewal. Auto-renew subscriptions renew automatically at the end of the respective term unless cancelled in due time before the end of the current period via the respective store. Billing is handled through the user’s respective store account.
Cancellation & management. On iOS, subscriptions can be managed and cancelled via the Apple ID or App Store settings, e.g. via Settings → [Your Name] → Subscriptions. On Android, subscriptions can be managed and cancelled via Google Play, e.g. via Google Play → Profile → Payments & subscriptions → Subscriptions. Cancellation takes effect at the end of the current period; already started periods are not refunded pro rata unless the respective store provides otherwise.
Free trials, offer codes & promotions. Where free trials, offer codes or other promotions are offered, the terms displayed in the respective store apply. After the end of a free or discounted period, a subscription may renew as a paid subscription unless cancelled in due time via the respective store.
Example plans (non-binding; the display in the respective store is authoritative): Weekly e.g. €3.99/week; Monthly e.g. €9.99/month; 6 months e.g. €44.99/6 months.
Refunds. Any refunds are processed in accordance with the policies of the respective store, i.e. the Apple App Store or Google Play.
Maintenance and support for the App is provided exclusively by Groopia UG, not by Apple or Google. Contact: service@groopia.com.
If the App was obtained through the Apple App Store, Apple assumes no warranty obligations for the App. If the App was obtained through Google Play, the applicable Google Play terms may additionally apply. Any product, legal, and consumer protection claims relating to the App must be directed to Groopia UG, unless mandatory law provides otherwise.
Our liability: We are liable without limitation in cases of intent and gross negligence, for injury to life, body, or health, and under the Product Liability Act. In cases of slight negligence, we are liable only for breach of essential contractual obligations (cardinal duties); in that case, liability is limited to the foreseeable, typical damage. Mandatory statutory warranty rights of consumers remain unaffected.
Apple Inc. and its affiliates are third-party beneficiaries of this EULA and are entitled to enforce this EULA against you.
The App may use third-party services/libraries. Additional terms may apply, which you may need to accept separately. We provide notices regarding open-source components (including licenses) in the App or on our website.
Information on the processing of personal data can be found in our Privacy Policy. It forms part of these T&C/EULA.
We may change the App, features, prices, subscriptions, or these T&C/EULA if there is an objective reason to do so (e.g., security, legal requirements, market conditions). We will inform you of material changes in an appropriate manner. There is no entitlement to permanent availability; maintenance periods may occur.
This EULA remains in effect until terminated. Your rights terminate automatically in the event of material breaches. You may delete the App at any time; statutory rights remain unaffected.
You may not use or export the App if doing so violates applicable export, sanctions, or embargo regulations.
The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumers with habitual residence in the EU enjoy the protection of mandatory provisions of their country of residence. If you are a merchant, Chemnitz shall be the exclusive place of jurisdiction.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr/.
